TruVelvet – Terms & Conditions
By creating an account, accessing the website, or streaming any content, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
TruVelvet, we, us, our: TruVelvet Pty Ltd.
Service: The TruVelvet website, streaming platform, applications, and related infrastructure.
User, you: Any individual who accesses or uses the Service.
Account: A registered TruVelvet user account.
Content: All films, restored films, videos, trailers, blog posts, mini-documentaries, still images, artwork, text, metadata, and audiovisual material made available via the Service.
Derivative Works: All digitally restored, upscaled, edited, graded, transferred, encoded, or otherwise modified versions of films created and owned by TruVelvet Pty Ltd, regardless of the source material’s original copyright status.
Plan: Any free or paid subscription tier offered by TruVelvet.
Device: Any internet-capable device with a supported web browser or approved casting functionality.
Territory: Australia and the United States of America only.
Payment Gateway: Stripe Payments Australia Pty Ltd.
2. Eligibility, Age Restriction, and Legal Capacity
TruVelvet is intended for mature audiences only.
By creating an Account, you confirm that: – You are 18 years of age or older; – You have the legal capacity to enter into binding contracts; and – You agree to comply with these Terms and all applicable laws.
Accounts created by minors or using false age information may be terminated immediately without refund.
3. Geographic Availability and Territory Restrictions
The Service is licensed for use only within the Territory.
- Access from outside Australia or the United States may be blocked or restricted.
- Certain Content may be geo-blocked based on licensing, rights availability, or technical limitations.
- No refunds are provided where access is unavailable due to geographic restrictions.
TruVelvet employs tokenised, geo-restricted content delivery systems to protect Content and enforce Territory limitations.
4. Subscription Plans
4.1 Red Carpet Preview – FREE Plan
– Free access to a curated selection of films
– No payment method required
– 2K or 4K streaming where available
“Free for life” means free for the life of the TruVelvet website, the TruVelvet business, or the Red Carpet Preview plan itself—whichever ends first.
TruVelvet reserves the right to rotate, replace, modify, suspend, or discontinue titles or the plan at any time.
4.2 Velvet Access – Monthly Plan
– Unlimited access to all TruVelvet Content
– Streaming on supported Devices
– Up to 4K resolution where available
Billing: – Initial charge of $12.99 AUD at signup – Recurring monthly charges billed one billing cycle after the initial payment – All fees are charged in Australian Dollars (AUD) regardless of user location – Payment details are securely tokenised and stored by Stripe
4.3 CineStudy Edition – 3 Month Plan
– Full access to all TruVelvet Content for three (3) months
– One-time payment of $19.99 AUD
Approved Use: – Non-commercial educational viewing – Classroom screenings permitted for up to 40 students
Public, ticketed, or commercial screenings of any size require a separate written screening licence agreement with TruVelvet Pty Ltd.
4.4 Director’s Cut – Annual Plan
– Twelve (12) months of full access
– One-time payment of $89.99 AUD
– Priority access to new restorations and releases
5. Payments, Refunds, and Cancellations
– All payments are non-refundable, including partial periods or unused time.
– Users may cancel subscriptions at any time to prevent future billing.
– Cancellation does not entitle the User to any refund.
6. Devices, IP Addresses, and Household Sharing
– Accounts are intended for private household use.
– TruVelvet permits family household sharing.
– A maximum of three (3) unique IP addresses per calendar day is permitted.
– Streaming is limited to three (3) concurrent Devices.
IP address and session data is logged and monitored to ensure fair use, security, and Content protection.
7. Acceptable Use Policy
Users must not: – Copy, screen-record, download, redistribute, scrape, mirror, resell, sublicense, or commercially exploit any Content; – Attempt to reverse engineer, decompile, or interfere with the Service; – Train artificial intelligence or machine learning models using TruVelvet Content; – Share Accounts beyond reasonable household use; – Circumvent geo-blocking or territorial restrictions.
VPN Usage: – VPN or proxy use to access Content outside the Territory is prohibited. – Detection of VPN usage may result in account flagging and enhanced monitoring. – Repeated or deliberate circumvention may result in suspension or termination without refund.
If a User accesses Content outside the Territory through circumvention methods, the User assumes full responsibility for any licensing, regulatory, or legal consequences. TruVelvet Pty Ltd bears no liability for such access.
8. Intellectual Property and Ownership
– TruVelvet Pty Ltd owns all rights in its Derivative Works.
– No ownership or licence is transferred to Users beyond personal, non-commercial viewing within the Service.
9. Suspension and Termination
TruVelvet may suspend or terminate any Account, without notice or refund, for: – Breach of these Terms; – Piracy or misuse; – Excessive or abnormal usage; – Attempts to hack, scrape, copy, or reverse engineer the Service.
10. Force Majeure
TruVelvet shall not be liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, internet outages, power failures, hosting interruptions, government actions, or third-party service failures.
11. Disclaimers and Limitation of Liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, TruVelvet Pty Ltd disclaims all warranties and shall not be liable for indirect, incidental, or consequential damages.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth legislation.
